Pennsylvania Child Seat Requirements

CHILD PASSENGER PROTECTION ACT 229 REQUIRES
• Children under the age of four (4) must be buckled into a federally-approved child passenger restraint system
(child safety seat), which must be secured to the vehicle by the seat belt system (or using the vehicle’s LATCH
system, available in newer vehicles), no matter where they ride in the vehicle (front or back seat).
• Children ages four (4) and older, but under the age of eight (8) must be buckled into a federally-approved child
booster seat, which must be secured to the vehicle by the seat belt system, no matter where they ride in a
vehicle (front or back seat). Booster seats must be used in conjunction with lap and shoulder belts.
• Children ages eight (8) and older, but under age 18 must be buckled in a seat belt, no matter where they ride
in the vehicle (front or back seat).
• Drivers are responsible for securing children into an approved child passenger restraint system and ensuring
children under age 18 are buckled up.

Teen Bullying Settlement Made Public

(CNN) -- The parents of a 15-year-old Massachusetts high school student who committed suicide after being bullied by her classmates received a nearly quarter-million-dollar settlement, according to documents made public after a months-long attempt to uncover details of the agreement.

The settlement was reached with the town of South Hadley in November of 2010, but it was only made public Tuesday after a reporter successfully sued to gain access to the records.

The reporter, Emily Bazelon from Slate Magazine, filed the public records lawsuit on December 2 with assistance from the American Civil Liberties Union, after first requesting the documents in May.

Superior Court Judge Mary-Lou Rup on Friday ordered the settlement be made public, adding that Bazelon "demonstrated that she, in her role as a news reporter, and the public have a First Amendment right to access the information contained in these settlement documents."

The agreement centers around the case of Phoebe Prince, whose body was found last year hanging in the stairway leading to her family's second-floor apartment.

On the day she died, Prince had endured a torrent of verbal abuse that began at the school library and continued as she walked home from school in tears, according to prosecutors.

Her parents, Anne O'Brien and Jeremy Prince, received the $225,000 settlement sum after filing a complaint with the state's Commission Against Discrimination in 2010, arguing that South Hadley Public Schools failed to address hazing that preceded their daughter's death.

Tougher Teen Driving Law Goes into Effect in Pennsylvania

Pennsylvania's new teen driving law, also known as "Lacey's Law" went into effect Tuesday, December 27, 2011 at midnight. The law was named after a Philadelphia teen who died in a car accident in 2007. The bill was signed by Governor Tom Corbett in October.

Since the bill was signed in October, there have been at least two fatal teen driving accidents in the Commonwealth. In December, five New Oxford high school students were in killed in a car crash. A day later, 16-year-old twins, along with their 9-year-old sister, died when their vehicle hit another car.

Under the law, having a passenger under 18 without a seatbelt is a primary offense, which means teens can be stopped and fined. During the first six months, after getting their license, teens can only have one person under 18 in the car with them. This does not include immediate family members. After the first six months, teens can have up to three passengers under 18.

The law also states teens must complete 65 hours of behind the wheel training. The previous requirement was 50 hours. The extra 15 hours are split between night driving and driving in inclement weather.

Cell phone tracking via GPS and location privacy is starting to emerge as a big issue, especially with more GPS enabled cell phones on the market. e911 rules require that your cell phone transmit your location data when you make a 911 call. New cell phones and smart phones have a feature commonly called "Location". When it is on, your phone is traceable.

For mobile phones to work, they have to be in regular contact with mobile cell towers. Location services uses cell tower locations to determine your approximate location. To track a cell phone, it has to be "On." There is no need to perform any activity, such as phone usage, emailing or text messaging, for it to be traceable.

Cell phone tracing is helpful in times of emergencies, for example, when a person is in need of help. Most rescue government centers, fire and police departments can use cell phone tracing to find locations of people in need of immediate assistance. This is very valuable in life-threatening situations wherein an individual may not be cohesive enough to describe his or her location--or example, in a case of a car accident or a missing person.

Some parents may find this feature handy to know the whereabouts of their children in case they are running late and they cannot get in touch with them. It can give them the added peace of mind.

Law enforcement officers can also take advantage of phone tracing in their investigative work to find locations of criminals whose cell phone numbers they are tracing.

Pennsylvania Top State for Deer Related Accidents

It's the time of year that deer are on the move. They are migrating and mating and often run into the roadway where they are struck by passing motorists, causing personal injury and property damage.

According to the National Highway Traffic Safety Administration there are about 1.5 million car accidents with deer each year that result in $1 billion in vehicle damage, about 150 human fatalities, and over 10,000 personal injuries. The actual numbers are probably higher because the National Highway Traffic Safety Administration's figures for deer accidents, rely on inconsistent state reporting- there is no standard reporting of deer accidents in the country yet, and a "reportable deer accident" varies significantly between states.

Thanksgiving was last week and Christmas is less than a month away. On December 24, 2011, New Rules for Teen Drivers Take Effect

"Lacey's Law" goes into effect on Christmas Eve. The new law for teen drivers provides new rules for junior drivers agee 16 1/2 to 18:

1. A limit on the number of passengers under age 18, with no more than one (except for immediate family members) for the first six months. No more than 3 after six months.

2. Increase in behind-the-wheel training from 50 to 65 hours. Must include 10 hours of nighttime and five hours of inclement weather driving.

3. Failure to use a seatbelt is now a primary offense.

Lacey Gallagher was killed on her prom night in 2007. She was a passenger in a car full of teenagers who were on the turnpike on their way to an after prom party. None of the seven kids in the car were wearing seatbelts. Their 2001 Suzuki XL-7 struck the center cement barrier causing the vehicle to spin and then roll over several times. All seven passengers were ejected during the accident.

PA Governor Corbett Signs New Teen Driving Law

Governor Corbett signed into law new safeguards for teenage drivers.

The changes include new restrictions on the numbers of non-family passengers a driver under age 18 can carry and an extension of the behind-the-wheel training component of the learner's permit period to include night and bad weather driving.

PA has restricted the number of young passengers teen drivers can take in their cars.

It also changes seat belt requirements to require drivers and passengers under age 18 to be belted at all times in a moving vehicle. If they are not, a police officer could pull over anyone suspected of violating that law and write them a $75 ticket.

The bill, known as "Lacey's Law" was sponsored by Rep. Kathy Watson, a Bucks County Republican, who had a constituent family lose their daughter, Lacey Gallagher, in an April 2007 crash where she was one of six teens riding in an SUV. None were wearing seat belts.

The passenger restrictions would limit new teen drivers to one other teen passenger for their first six months with a license. With no accidents or traffic violations in that time, the limit goes to three for the duration of the junior license.

Pennsylvania Department of Transportation reports show teenagers continue to have a disproportionately high number of crashes.

TEXTING WHILE DRIVING BANNED IN PA

HARRISBURG — Pennsylvania is getting set to join more than 30 other states that ban all motorists from texting while driving.

The state Senate's 45-5 vote on Tuesday approved an amended version of a bill it easily passed in June and sent it to the desk of Gov. Tom Corbett, who is expected to sign it. The ban would take effect 120 days after Corbett signs it.

Although the House stripped out a provision that would also punish drivers for talking on a cell phone without a hands-free device, proponents still looked at the bill's passage as a victory.

"All the rest of your life for the simple thing of texting a friend you have to live with the fact that you did not have control of your vehicle and you killed somebody," Sen. John Wozniak, D-Cambria, told colleagues in a floor speech before the vote.

Among the five senators voting "no" was Charles McIlhinney, R-10, of Doylestown.

McIlhinney said he voted against the bill because he doesn't think it clearly defines texting.

"When you have a smartphone, as a lot of people do, it is not illegal to use the GPS on it or to make a phone call on it. But is illegal to text. Is pushing the keys to make a call texting? How do the police prove you were texting and not using your GPS?" he asked.

McIhinney said he would have had no problem supporting the bill if it made texting a secondary offense or if it banned the use of all mobile devices.

One of the other senators, Mike Folmer of Lebanon County, said the state already has laws against distracted or reckless driving, and that adding this law to the books won't make people any more responsible.

"We don't need another nanny bill to be passed to make us feel better and, secondly, how's that going to help teach responsibility?" he said.

The bill would make texting behind the wheel a primary offense so that police can pull over motorists for that violation alone. The penalty is $50. Police will not be allowed to seize the cell phone or other device.

Talking on a cell phone without a hands-free device remains legal for Pennsylvania motorists, despite years of attempts by the Senate and some House lawmakers to outlaw it. Nine states have such bans.

In Lower Bucks, the legislation received enthusiastic support.

Sen. Robert "Tommy" Tomlinson, R-6, of Bensalem said the approved legislation was "one of the most important things we can do to prevent needless tragedies."

"Texting is one of the most dangerous distracted driving activities that motorists engage in," Tomlinson said. "When you text, you have to take your eyes off the road, you aren't paying attention, and the consequences can be deadly."

Lower Makefield police Chief Ken Coluzzi said he's glad the law makes texting while driving a primary offense. This will make it more enforceable than if it were a secondary offense.

"Distracted driving is one of the biggest causes of crashes," he said Tuesday. "Any distracted driving is really serious. ... It can be deadly.

"Everybody does it," he said of texting behind the wheel, "it's not just kids."

Northampton police Chief Barry Pilla said he's "100 percent in favor of anti-distraction while operating motor vehicle legislation" and tipped his hat to local officials and Corbett for pushing the issue.

His and other police departments along with the Council Rock School District have been driving home the don't-text-while-you-drive message with a safety awareness campaign.

Their slogan: "Keep your eyes on the road; keep your hands on the steering wheel; and stay focused on the task at hand — operating your vehicle."

"All too often crashes occur because the operator was distracted for any number of reasons," Pilla said. "We've all seen motorists talking on their cell phones or texting or eating or putting on make-up. When they crash they can't seem to understand why it happened to them. Many motorists seem to forget that while they are occupied being distracted they are still operating a 2,000-pound machine at whatever speed down the road amongst traffic and pedestrians."

The bill that passed the Senate in June banned both texting while driving and talking on a cell phone while driving without a hands-free device. However, after the House approved the texting ban on Monday, House Majority Leader Mike Turzai, R-Allegheny, said that his chamber would continue to consider a ban on talking on cell phones.

Corbett last week signed into law tougher new regulations for teen drivers, including limits on how many passengers they can carry and more stringent training requirements.

Full Tort or Limited Tort?

My insurance agent told me that I will save money on my auto insurance if I choose Limited Tort. I don't understand what that means. I thought I had "full coverage". Should I select Full or Limited Tort?

What an insurance company may call "full coverage" is not always full protection. Insist on Full Tort. This is the unlimited right to sue for pain and suffering. Limited Tort can limit this right so that you cannot bring a claim for anything other than your economic losses, such as the damage to your car, your lost wages, and your medical expenses. There are a few exceptions to Limited Tort. If you select Limited Tort you can still bring a claim for pain and suffering in the following circumstances:

If the injury suffered is a severe disfigurement, a serious impairment of a bodily function or death;

If the person at fault is convicted or accepts ARD for driving under the influence of alcohol or a controlled substance in the accident;

If the person at fault is operating a motor vehicle registered in another state;

If the injured person was injured while an occupant of a motor vehicle other than a private passenger motor vehicle; such as a motorcycle, bus, taxi, or work vehicle.

If you select Limited Tort, you are making a selection that affects your rights, your household members rights and your children's rights before an accident even happens. You may save a few dollars now in premium expenses while in the event of a future accident you will have no right to compensation for pain and suffering.

My advice is to purchase as much insurance as you can afford. You are paying to insure yourself and your family and making sure that you are fully compensated if you are hurt by someone else's negligence.
